The disability claims process is particularly eye-opening for those experiencing it for the first time. Insurance companies have vast resources at their disposal, often making the disability claim process as daunting as possible in pursuit of their own financial interests. Our clients initially don’t realize that disability insurance companies staff claims not only with an analyst, but one or more physicians, and legal counsel, and often a surveillance company, among others. Thus, there is literally a team of individuals working together to find any viable reason not to pay your claim, and our firm’s job is to even the playing field and make sure you get paid.
Ideally, we work with doctors and other professionals from the moment they realize that they may need to file a disability insurance claim on their own-occupation policy or policies. We help them to assess whether they do or do not have a valid disability claim and can collect benefits. If they do, we help our clients determine when they need to file (particularly if they have a slowly progressive condition, like wrist, neck or back problems) and/or need to sell their practice. Then, when it comes time to file, we handle all aspects of the claim. We work with our clients to gather all necessary documentation and require that the disability insurance companies coordinate all requests for information through our office, so that we can monitor the requests and ensure that they are warranted and appropriately carried out. When disability insurance companies require interviews (of yourself, your employer, your staff and others), Independent Medical Exams (IMEs), Functional Capacity Exams (FCEs), or other examinations, our firm ensures that their representatives do not engage in improper questioning or bad faith conduct.
We continuously monitor each disability claim and utilize our extensive industry knowledge to preemptively identify, document, and combat the insurance companies’ improper, bad-faith tactics, including improper and intrusive surveillance, before these tactics come to fruition in a claim denial or termination of benefits. We also handle cases with doctors and other professionals whose insurance companies have wrongfully denied coverage or attempted to terminate benefits.
