I suffered greatly from an inoperable arachnoid cyst in my brain that caused periodic slow-bleeding hemorrhages. I received benefits for over a year without a problem until my insurance company transferred my claim to its “complex claims unit.” My insurance company then forced me to do several ‘independent’ medical exams and interviews—in some cases only a few weeks apart.  When they terminated my benefit payments, which was shocking, they said that I had to send an appeal to them under ERISA before I could file a lawsuit. I had never heard of this law.  So I tried to appeal based on what they told me and ended up going over a year without benefits waiting for an appeal decision that ended up being a denial.  When I finally talked to Ed, he told me that ERISA actually didn’t apply to my policy and the language in the denial letter was meant to put me in a bad financial position and discourage attorneys from taking my case.  Once Ed got involved, the insurance company changed its tune and eventually overturned the denial and paid me.  Ed then sued them for breach of contract and bad faith, and we settled. Ed and his team were amazing. My only regret is that I wish I had called him sooner.
