Does Delaware Recognize Insurance Bad Faith?

Delaware recognizes an implied covenant of good faith and fair dealing, and the Delaware Supreme Court has held that “[this] implied covenant attaches to every contract, including contracts of insurance.” Dunlap v. State Farm Fire & Cas. Co., 878 A.2d 434, 440–42 (Del. 2005) (internal citations omitted).

As explained by the Delaware Supreme Court, “[s]tated in its most general terms, the implied covenant requires ‘a party in a contractual relationship to refrain from arbitrary or unreasonable conduct which has the effect of preventing the other party to the contract from receiving the fruits’ of the bargain.” Id.

Notable Delaware Disability Insurance Cases

Oglesby v. Penn Mutual Life Insurance Co., 877 F. Supp. 872 (D. Del. 1994) (Delaware radiologist with disabling arm, shoulder and neck pain filed a disability claim; Dr. Oglesby spent 80% to 100% of his time working within a sub-specialty of the radiology discipline known as interventional and vascular radiology but following the onset of the neck, shoulder and arm pain, he was no longer able to perform any hands-on vascular or interventional radiology procedures, although he was able to read routine radiology films and function as a general radiologist; the court found that Dr. Oglesby’s regular occupation for purposes of disability benefits was that of an interventional and vascular radiologist and not a general radiologist).

Coughlin v. Connecticut Gen. Life Ins. Co., 330 A.2d 159, 160 (Del. Super. Ct. 1974) (Delaware welder filed a disability claim due to arthritis and ongoing leg pain after an attempted surgery to address it; the insurance company asserted that he needed to look more aggressively for a new job; the court determined that ongoing pain was a relevant factor and held that the policyholder had met the “burden of proving that he has been wholly and continuously disabled by sickness and has been unable to engage in any occupation or employment for wage or profit for which he is reasonably suited by education, training or experience”).
