Does Massachusetts Recognize Insurance Bad Faith?

Massachusetts recognizes a duty of good faith but also has statutes that govern the insurer-policyholder relationship. As explained by the Appeals Court of Massachusetts “an insurer has an obligation to act in good faith, to ‘exercise common prudence to discover the facts as to liability and damages upon which an intelligent decision may be based.’” Green v. Blue Cross & Blue Shield of Massachusetts, Inc., 47 Mass. App. Ct. 443, 446, 713 N.E.2d 992, 996 (1999) (internal citations omitted).

Additionally, Massachusetts’s Consumer Protection Act “applies to the insurance industry” and “was a legislative attempt ‘to regulate business activities with the view to providing proper disclosure of information and a more equitable balance in the relationship of consumers to persons conducting business activities.’” Id.  “There is no binding definition of what constitutes an unfair practice”; rather, “[t]he existence of unfair acts and practices must be determined from the circumstances of each case.” Id.

Notable Massachusetts Disability Insurance Cases

Leitzes v. Provident Life and Accident Ins. Co., 379 F.Supp.2d 15 (D.Mass. 2005) (Physician who specialized in orthopedic medicine filed an “own occupation” disability claim due to disc herniation but continued to conduct office visits; the court held that Unum properly determined he was not totally disabled under disability insurance policy’s post-age-65 definition of total disability and was still engaging in his occupation).

Giampa v. Trustmark Ins. Co., 73 F. Supp. 2d 22, 29 (D. Mass 1999) (Massachusetts chiropractor (who also had practices in Florida) injured his back and filed a disability claim; the court determined that he was disabled from engaging in 85% to 95% of his previous substantial and material duties and was entitled to total disability benefits “even if his disability does not prevent him from performing an incidental job duty”).
